Pursuant to the provisions of the reference, Petitioner, an enlisted service member of the Marine Corps, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his record be corrected by removing his Administrative Remark (page 11) entries dated 9 June 2014, 15 July 2014, 27 April 2015, 1 September 2015, and 22 January 2016 from his official military personnel file (OMPF). 2. The Board, consisting of reviewed Petitioner's allegations of error and injustice on 24 November 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 9 June 2014, Petitioner was issued enclosure (2), a page 11 entry notifying him that he is eligible but not recommended for promotion to the rank of corporal, due to being unable to pass the Physical Fitness Test (PFT). b. On 15 July 2014, Petitioner was issued enclosure (4), a page 11 entry notifying him that he is eligible but not recommended for promotion to the rank of corporal for the month of August, due to being unable to pass the PFT. c. On 27 April 2015, Petitioner was issued enclosure (5), a page 11 entry notifying him of his assignment to the remedial conditioning program (RCP). d. On 1 September 2015, Petitioner was issued enclosure (6), a page 11 entry notifying him of his unsatisfactory progress while assigned to the BCP. e. On 22 January 2016, Petitioner was issued enclosure (7), a page 11 entry notifying him of his extension on the BCP due to his failure to comply with Marine Corps height/weight standards. f. Petitioner contends that he had passing Physical Fitness Test (PFT) scores for the contested periods and was within Marine Corps height and weight standards. Petitioner also contends that his record does not contain supporting documentation for his assignment on the Body Composition Program (BCP). CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an error warranting partial corrective action. The Board noted that pursuant to the Marine Corps Individual Records Administration Manual (IRAM), Petitioner was properly counseled and determined that the contested entries were written and issued in accordance with the IRAM. The Board also noted that pursuant to the Marine Corps Body Composition Program Manual, Petitioner was properly counseled for his assignment to the remedial conditioning program, for his unsatisfactory progress during his first BCP assignment and his extension on the BCP. The Board reviewed Petitioner’s Marine Corps Total Force Structure (MCTFS) electronic record and noted, too, that his recorded BCP assignment and extension is consistent with Petitioner’s contested page 11 entries. The Board found no evidence that Petitioner passed his PFT noted in his 9 June 2015 and 15 July 2014 page 11 entries and he provided none. Concerning Petitioner’s 9 June 2014 counseling entries, the Board noted that the page 11 entry was not signed by Petitioner. The Board determined that according to the IRAM, Marines not recommended for promotion in the grade of private first class through sergeant will acknowledge the entry. The Board concluded that Petitioner’s 9 June 2014 page 11 entry and duplicate 9 June 2014 page 11 entry are in error and shall be removed. The Board also concluded that Petitioner’s 15 July 2014, 27 April 2015, 1 September 2015 and 22 January 2016 page 11 entries are valid and shall be retained as file. RECOMMENDATION In view of the above, the Board directs the following corrective action. Petitioner’s naval record be corrected by removing his 9 June 2014, Administrative Remarks (page 11) entry and 9 June 2014 duplicate page 11 entry. No other changes to Petitioner’s record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5. Pursuant to the delegation of authority set out in Section 6(e) of the revised Procedures of the Board for Correction of Naval Records (32 Code of Federal Regulations, Section 723.6(e)), and having assured compliance with its provisions, it is hereby announced that the foregoing corrective action, taken under the authority of reference (a), has been approved by the Board on behalf of the Secretary of the Navy.
