Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was authorized 20 days Permissive Temporary Duty (PTDY) for Job/House Hunting. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 24 November 2020 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 24 September 2018, Petitioner was issued official retirement orders (BUPERS order 2678) with an effective date of 1 April 2019. c. On 2 November 2018, Petitioner was issued official modification to retirement orders (BUPERS order: 2678) with an effective date of 1 January 2019. d. On 31 December 2018, Petitioner honorably retired. Petitioner’s DD Form 214 (Certificate of release or discharge from active duty) listed days accrued leave paid 1.0. e. On 14 January 2019, Petitioner was charged terminal leave from 13 October 2018 to 31 December 2018 (80 days). f. On 28 August 2019, DWOWS Edit Case Details Screen stated the following: “Request assistance getting member pay account corrected. The member took 60 days of terminal leave. Then he also took 20 days of permissive TDY/job hunting and house hunting leave, which is non-chargeable. The 60 days was charged correctly at first but then the member was incorrectly charged 80 days.” g. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. Petitioner was erroneously charged leave while on Permissive Temporary Duty (PTDY) Authorization for Job/House Hunting. In accordance with reference (b), PTDY may be taken in conjunction with terminal leave immediately upon completion of all separation processing. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was authorized Permissive Temporary Duty (PTDY) for Job/House Hunting from 13 October 2018 to 1 November 2018 (20 days). Note: Petitioner will be credited with 20 days leave that was erroneously charged. Defense Finance and Accounting Service (DFAS) will complete an audit of Petitioner’s records to determine if Petitioner is due any back pay and allowances. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above entitled matter. 5.
