Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and received the FY20 Aircraft Maintenance Kicker. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 5 August 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 25 February 2008, Petitioner entered active duty. c. On 21 November 2017, Petitioner reenlisted for 2 years with an end of current contract (ECC) of 20 November 2019. d. On 23 November 2017, Petitioner signed an agreement to extend enlistment for 3 months with an end of active service (EAS) of 20 February 2020 in order to have sufficient obligated service for permanent change of station orders (PCSO). e. On 1 October 2018, Petitioner was promoted to Staff Sergeant/E-6. f. On 15 February 2018, Petitioner joined for duty. g. On 24 May 2019, Petitioner joined for duty. h. In accordance with reference (b), this bulletin announces the Selective Retention Bonus (SRB) program and the Broken Service SRB (BSSRB) program authorized for FY20. With the advent of several new SRB programs, Marines are encouraged to thoroughly review the contents of this bulletin. First term Marines (Zone A) and career Marines (Zone B, C, D and E) who reenlist on or after 5 July 2019 are eligible for the FY20 SRB program. This will include any regular component first term or career Marine with an ECC from 1 October 2019 to 30 September 2020. All Corporals through Gunnery Sergeants holding current qualifications and Necessary MOSs (NMOS) of 6012-Safe For Flight (SFF) Controller, 6016-Collateral Duty Inspector (CDI), 6017-Collateral Duty Quality Assurance Representative (CDQAR), or 6018-Quality Assurance Representative (QAR), in the below monitored command codes (MCC)s who reenlist for 48 months, and agree to remain in a specified MCC for the first 24 months (following the end of their current contract), will rate a 20,000 dollar kicker in addition to the primary military occupational specialties (PMOS) bonus amount listed in section(s) 3.m, 3.n, and 3.o. If no PMOS bonus is listed in section(s) 3.m, 3.n, and 3.o, the Marine rates a lump sum bonus of 20,000 dollars. MCCs Authorized for Aircraft Maintenance Kicker: “…VM3…” i. On 13 November 2019, Petitioner’s Careerist Active Duty Reenlistment request was submitted. j. On 13 December 2019, Petitioner signed an agreement to extend enlistment for 4 months with an EAS of 20 June 2020 in order to have additional time awaiting a response from Headquarters, U.S. Marine Corps (HQMC). k. On 2 March 2020, Petitioner signed an agreement to extend enlistment for 3 months with an EAS of 20 September 2020 in order to have additional time awaiting a response from HQMC. l. On 29 May 2020, Petitioner’s Careerist Active Duty Reenlistment request was approved by HQMC. m. On 6 June 2020, Petitioner reenlisted for 4 years with an ECC of 5 June 2024. n. On 22 February 2021, Petitioner signed an agreement to extend enlistment for 2 months with an EAS of 5 August 2024 in order to obligate service for orders to MCC 1JN. o. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner held the qualifications of 6016-CDI and was at the listed MCC VM3 making him eligible to receive the FY20 Aircraft Maintenance Kicker. Due to no fault of Petitioner, his request was not submitted properly resulting in him not receiving the kicker. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: The enlistment/reenlistment document (DD Form 4) executed on 6 June 2020 was for a term of 4 years and 1 month, vice 4 years. Note: This change will entitle the member to the $20,000 FY20 Aircraft Maintenance Kicker. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
