Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to establish eligibility to receive Basic Allowance for Housing (BAH) at the old permanent duty station (PDS) rate. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 13 April 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, he exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. On 31 May 2019, Petitioner closed on his home at . b. On 25 March 2020, Petitioner was issued (Official Modification to Change Duty Orders). c. On 15 December 2020, Petitioner detached OPNAV, . d. On 16 December 2020, Petitioner reported to the United States . e. Petitioner submitted a close proximity move request to the . f. On 29 January 2021, approved Petitioner’s request for a close proximity move. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an injustice warranting the following corrective action. Although Petitioner failed to complete the administrative requirements outlined in reference (b) prior to detaching OPNAV, he did garner approval from to commute daily from residence to PDS; therefore, the Board felt that under these circumstances, relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s request for close proximity move was submitted to cognizant authority prior to 15 December 2020. The request was approved and household goods funding was removed from prior to 15 December 2020. Petitioner was authorized BAH at the with-dependent rate for , from 16 December 2020 to present. Note: Petitioner must maintain continuous residence at to qualify for BAH based on previous PDS. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4.
