Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and received a Selective Reenlistment Bonus (SRB). 2. The Board, consisting of Ms. Ms. and Mr. reviewed Petitioner’s allegations of error and injustice on 12 August 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 14 January 2013, Petitioner entered active duty for 4 years with an end of active obligated service (EAOS) of 13 January 2017 and soft end of active obligated service (SEAOS) of 13 January 2019. c. In March 2014, Petitioner earned NEC T33A (Legacy NEC is 3303). d. In accordance with reference (b), this NAVADMIN announces revised Selective Reenlistment Bonus (SRB) award levels and reenlistment policy for active component and Full-Time Support (FTS). This NAVADMIN supersedes reference (a). Rating modernization efforts have no impact on this program and traditional rating titles are used throughout this NAVADMIN. Increased award levels are effective immediately and decreased levels are effective 30 days after the release of this NAVADMIN. Sailors must reenlist within 90 days and in the same fiscal year as their End of Active Obligated Service (OBLISERV (EAOS)), except in the following cases: a. Nuclear trained Sailors. b. Sailors eligible for combat zone tax exclusion (CZTE) are authorized to reenlist anytime within the same fiscal year as their EAOS. c. Sailors who received an Early Promote in block 45 of their most recent regular periodic evaluation will be allowed to reenlist early any time within the fiscal year of their EAOS. Commands are required to submit SRB reenlistment requests to PERS-81 via OPINS or NSIPS 35 to 120 days in advance of the Sailors requested reenlistment date. Requests submitted less than 35 days prior to the requested reenlistment date will be rejected. Furthermore, a zone “B” SRB with an award level of 0.5 ($45,000 award ceiling) for the MT/33XX rate/NEC was authorized. e. On 12 January 2017, Petitioner reenlisted for 6 years with an EAOS of 11 January 2023. f. On 29 September 2017, Petitioner was issued official change duty orders (BUPERS order: 2727). Furthermore, he was directed to an ultimate activity for duty at . g. On 12 April 2018, Petitioner signed an agreement to extend enlistment for 1 months with an SEAOS of 11 February 2023 for CONSUBPAY and/or bonus eligibility purposes. h. On 25 June 2018, Petitioner transferred from duty station. i. On 14 May 2021, Petitioner reenlisted for 6 years with an EAOS of 13 May 2027. j. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner was eligible for an SRB for his 6-year term reenlistment effective 12 January 2017. If the Command Career Counselor had submitted Petitioner’s SRB precertification request to BUPERS-328 within 35 to 120 days in advance of the requested reenlistment date, it would have been approved. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s Command submitted a timely request for his SRB to BUPERS-328 via OPINS/NSIPS and it was approved by cognizant authority. Note: This change will entitle the member to a zone “A” SRB with an award level of 0.5 ($45,000 award ceiling) for the MT/33XX rate/NEC. Remaining obligated service to 13 January 2017 will be deducted from SRB computation. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
