Pursuant to the provisions of reference (a), Petitioner is the daughter of the deceased former service member, hereinafter referred to as Subject. Petitioner filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that Subject’s naval record be correct by adjustment of the date of birth listed on Subject’s discharge documents from 25 October 1925 to 28 October 1925. Enclosures (1) through (3) apply. 2. The Board, consisting of reviewed Petitioner's allegations of error and injustice on 21 April 2021, and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of his naval service records, and applicable statutes, regulations, and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, it is in the interest of justice to review the application on its merits. c. Subject enlisted in the Navy and began a period of active duty on 2 November 1942. On 24 December 1946, Subject was discharged with an honorable characterization of service. d. Subject was issued a Notice of Separation from US Naval Service (NAVPERS-553) which incorrectly reflects a date of birth as e. Subject’s service record book (SRB) reflects his date of birth as during his active service. Additionally, Petitioner provides Subject’s birth certificate and death certificate which reflect Subject’s date of birth as CONCLUSION: Upon review and consideration of all the evidence of record, the Board determined that Subject’s discharge document contains an administrative error, therefore Petitioner’s request warrants favorable action. The Board notes the Petitioner provides legal evidence which reflect Subject’s correct date of birth as Additionally, Subject’s SRB reflects the correct date of birth as In view of the above, the Board directs the following corrective action. RECOMMENDATION: That Subject’s naval record, be corrected to reflect the correct date of birth as That Subject be issued a Correction to DD Form 214, Certificate of Release or Discharge from Active Duty (DD Form 215). That a copy of this Report of Proceedings be filed in Subject’s Naval record. That, upon request, the Department of Veterans Affairs be informed that Petitioner's application was received by the Board on 23 April 2020. 4. It is certified that a quorum was present at the Board's review and deliberations, and that the foregoing is a true and complete record of the Board's proceedings in the above entitled matter. 5.
