Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was eligible for and received an Early Reenlistment Kicker. 2. The Board, consisting of , and , reviewed Petitioner’s allegations of error and injustice on 26 August 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. On 30 July 2013, Petitioner entered active duty. c. On 19 January 2017, Petitioner reenlisted for 4 years with an End of Current Contract (ECC) of 18 January 2021. d. In accordance with reference (b), this bulletin announces the Selective Reenlistment Bonus (SRB) program and the BSSRB program authorized for FY21. With the advent of several new SRB programs, Marines are encouraged to thoroughly review the contents of this bulletin. First term Marines (Zone A) and career Marines (Zone B, C, D, and E) who reenlist on or after 7 July 2020 are eligible for the FY21 SRB program. This will include any regular component first term or career Marine with an ECC from 1 October 2020 to 30 September 2021. Marines in Zones A, B, and C who submit for a 48 month reenlistment between 7 Jul 20 through 30 Sep 20 with a Primary Military Occupational Specialty (PMOS) that is listed in section(s) 3.l, 3.m, and 3.n, and are subsequently approved, will rate an 8,000 dollar Early Reenlistment Kicker in addition to the PMOS bonus amount listed in section(s) 3.l, 3.m, and 3.n. After 30 September 2020, this Early Reenlistment Kicker will expire. Zone B applies to those active component Marines with 6 to 10 years of active military service. Marines with exactly 10 years of active service on the date of reenlistment may be paid a Zone B PMOS bonus if they have not previously received a Zone B PMOS bonus. Zone B PMOS bonus payments for Marines who reenlist for at least 48 months obligated service are authorized as listed below in dollars (bonuses for Marines who reenlist for 36 to 47 months obligated service will be calculated as per para 3.i). Furthermore, a zone “B” SRB for MOS 0211LM, which is capped at $47,500 for 48 months of additional obligated service was authorized. e. On 3 August 2020, Petitioner’s Careerist Active Duty lateral Move request was submitted, and was disapproved by HQMC on 18 August 2020. Petitioner’s PMOS was 2847. f. In accordance with reference (c) [9 September 2020], Petitioner was listed on the FY20 Approved Selections to Staff Sergeant. g. On 17 October 2020, Petitioner signed an agreement to extend enlistment for 5 months with an End of Active Service (EAS) of 18 June 2021 to await response from HQMC on pending reenlistment. h. On 1 March 2021, Petitioner was promoted to Staff Sergeant/E-6. i. On 4 March 2021, Petitioner’s Careerist Active Duty lateral Move request was submitted. j. On 9 March 2021, Petitioner signed an agreement to extend enlistment for 21 months with an EAS of 18 March 2023 in order to obligate service for promotion to Staff Sergeant. On 26 March 2021 it was cancelled. k. On 23 March 2021, Petitioner’s Careerist Active Duty lateral Move was approved by HQMC. Petitioner was approved for PMOS 0211. l. On 27 March 2021, Petitioner reenlisted for 4 years and 3 months with an ECC of 26 June 2025. m. In correspondence attached as enclosure (2), the office having cognizance over the subject matter addressed in Petitioner’s application has commented to the effect that the request has merit and warrants favorable action. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of enclosure (2), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that Petitioner submitted his reenlistment request in a timely manner but due to the needs of the service, the reenlistment was disapproved. Due to no fault of Petitioner, he missed the opportunity to receive the Early Reenlistment Kicker on his first lateral move request. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Paragraph B8b (Remarks) of the DD Form 4/1 executed on 27 March 2021 listed the following: REENLISTED FOR THE FOLLOWING INCENTIVE(S): ZONE B SRBP AMOUNT $47,500 AND AN $8,000 EARLY REENLISTMENT KICKER. I UNDERSTAND THAT THIS REENLISTMENT CONTRACT IS CONTINGENT UPON SUCCESSFUL COMPLETION OF THE TRAINING REQUIREMENTS FOR MOS 0211. SHOULD I FAIL TO COMPLETE THE TRAINING REQUIREMENTS FOR MOS 0211, I MAY BE REVERTED TO MY PREVIOUS MOS OR SEPARATED FROM THE MARINE CORPS.” Note: This change will entitle the member upon completion of training to a zone “B” SRB for MOS 0211LM, which is capped at $47,500 for 48 months of additional obligated service. Remaining obligated service to 18 June 2021 will be deducted from SRB computation. Furthermore, Petitioner is entitled to an $8,000 Early Reenlistment Kicker. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
