Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that her naval record be corrected to reinstate three satisfactory years loss due to administrative change to Reserve anniversary date from 22 August to 14 December. 2. The Board, consisting of Ms. Mr. and Ms. reviewed Petitioner’s allegations of error and injustice on 19 August 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, found that, before applying to this Board, she exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. The Board made the following findings: a. In accordance with reference (b), time served in a Service academy is not creditable for pay purposes. b. After 22 August 2020, Petitioner’s Reserve anniversary date was corrected from 22 August to 14 December. Prior to this correction Petitioner had 12 years of qualifying service for retirement purposes. The year ending 21 August 2015 was unsatisfactory with 33 total reserve points. After the correction, the following years were unsatisfactory: 13 December 2014 (49) points, 13 December 2015 (42) points, and 13 December 2017 (45) points; modifying Petitioner’s qualifying years for retirement from 12 years to 10 years. CONCLUSION Upon review and consideration of all the evidence of record, the Board finds the existence of an injustice warranting the following corrective action. The Board determined the Service’s administrative correction to the Petitioner’s Reserve anniversary date was appropriate in accordance with reference (b). However, the Board concluded the administrative correction only created two unsatisfactory years of participation, 13 December 2014 and 13 December 2017. Therefore, the Board felt under these circumstances, partial relief is warranted. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: One (1) Inactive Duty Training point was transferred from anniversary year ending 13 December 2013 to the anniversary year ending 13 December 2014. Five (5) Inactive Duty Training points were transferred from anniversary year ending 13 December 2018 to the anniversary year ending 13 December 2017. Note: These changes will result in a satisfactory years of service for anniversary years ending 13 December 2014 and 13 December 2017. The part of Petitioner’s request for corrective action that exceeds the foregoing is denied. Prior to the administrative correction to Petitioner’s Reserve anniversary date, year ending 21 August 2015 already reflected as unsatisfactory. A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
