Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was reimbursed for his household goods (HHG) move. 2. The Board, consisting of reviewed Petitioner’s allegations of error and injustice on 29 June 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice, finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b) [May 2020], HHG allowances are based on the PCS order’s effective date; although, the HHG may be transported as long as the HHG authority remains in effect. The weight allowance is based on the grade held on the effective date of the order authorizing the HHG transportation. c. On 22 January 2020, Petitioner’s HHGs were picked up by from to d. On 16 June 2020, Petitioner was issued official fleet reserve orders (BUPERS order: 1680), with adetaching date of August 2020. Furthermore, retired members who have designated a home of selection and received an advance must submit a travel claim to the appropriate disbursing officer as indicated on the travel order within 10 days of the date the advance was paid per JTR chapter 5. Sailor's home of record: Sailor's place of entry to active duty (PLEAD): Home of selection: HOS: deferred, SPD: NBD character of service: honorable effective date of retirement: 31 August 2020. e. On 10 July 2020, Petitioner began travel from and arrived to on 12 July 2020. f. On 31 August 2020, Petitioner transferred to the Fleet Reserve. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that even though Petitioner moved his HHG prior to the issuance of his orders, it is reasonable to conclude that Petitioner knew that retirement orders would be forthcoming. Once orders were issued, he was entitled to an HHG move at government expense. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner’s BUPERS order: 1680 were issued on “21 January 2020” vice “16 June 2020”. Note: Petitioner is advised to resubmit his orders, travel claim, all receipts, and a copy of this Board of Correction of Naval Records (BCNR) decision letter to the Household Good Audit Team (HHG-AT) for re-adjudication. Settlement of this travel claim is chargeable to the line of accounting on the Petitioner’s official separation orders (BUPERS order: 1680). A copy of this Report of Proceedings will be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
