After careful and conscientious consideration of relevant portions of your naval record and your application, the Board for Correction of Naval Records (Board) found the evidence submitted was insufficient to establish the existence of probable material error or injustice. Consequently, your application has been denied. A three-member panel of the Board, sitting in executive session, considered your application on 24 August 2021. The names and votes of the members of the panel will be furnished upon request. Your allegations of error and injustice were reviewed in accordance with administrative regulations and procedures applicable to the proceedings of this Board. Documentary material considered by the Board consisted of your application, together with all material submitted in support thereof, relevant portions of your naval record and applicable statutes, regulations, and policies. In addition, the Board considered the advisory opinion contained in Navy Personnel Command memorandum 1070 PERS-312/DV of 12 February 2021; a copy of which was previously provided to you for comment. On 1 November 2000, you signed a Record of Military Processing – Armed Forces of the U.S. (DD Form 1966) with a home of record (HOR) of , NJ. On 7 November 2000, you signed an Enlistment/Reenlistment Document Armed Forces of the United States (DD Form 4) for 8 years in the U.S. Naval Reserve with a HOR of , NJ. On 27 December 2000, you entered active duty for 4 years with an End of Active Obligated Service (EAOS) of 26 December 2004. On 26 December 2004, you were honorably released from active duty upon completion of required active service. Your Certificate of Release or Discharge from Active Duty (DD Form 214) listed a HOR of , . On 15 July 2005, you signed a DD Form 1966 listing your HOR as . On 17 January 2006, you signed a DD Form 4 for 2 years in the U.S. Navy with a HOR of , . On 30 October 2020, you were notified by Navy Personnel Command that your request to change your HOR to was denied. On 23 August 2021, NSIPS/ESR Form (Member Information) was printed listing your HOR as , . You requested that your HOR be corrected to reflect , ; the Board, in its review of your entire record and application, carefully weighed all potentially mitigating factors, to include your assertions. However, the Board concluded that your record is correct. In accordance with Joint Federal Travel Regulations (2005), the HOR is defined as the place recorded as the home of the individual when commissioned, appointed, enlisted, inducted, or ordered into a tour of active duty. Only if a break in service exceeds one full day may the member change the HOR. On 15 July 2005, after a break in active service, you signed a DD Form 1966 and a DD Form 4 listing your HOR as . In this connection, the Board substantially concurred with the comments contained in the advisory opinion. You are entitled to have the Board reconsider its decision upon submission of new matters, which will require you to complete and submit a new DD Form 149. New matters are those not previously presented to or considered by the Board. In this regard, it is important to keep in mind that a presumption of regularity attaches to all official records. Consequently, when applying for a correction of an official naval record, the burden is on the applicant to demonstrate the existence of probable material error or injustice.
