Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting that his naval record be corrected to show Petitioner was reimbursed for the execution of his Household Goods (HHG) moves. 2. The Board, consisting of , reviewed Petitioner’s allegations of error and injustice on 12 August 2021 and, pursuant to its regulations, determined that the corrective action indicated below should be taken on the available evidence of record. Documentary material considered by the Board consisted of the enclosures, relevant portions of Petitioner’s naval record, and applicable statutes, regulations and policies. 3. The Board, having reviewed all the facts of record pertaining to Petitioner’s allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. In accordance with reference (b), HHG allowances are based on the PCS order’s effective date; although, the HHG may be transported as long as the HHG authority remains in effect. The weight allowance is based on the grade held on the effective date of the order authorizing the HHG transportation. c. On 10 March 2021, COMANVPERSCOM notified command that the Secretary of the Navy directed the Permanent Disability Retirement with disability at 40 percent. Release from active duty 28 May 2021, retirement effective 29 May 2021. d. On 16 April 2021, Petitioner completed a Travel Voucher or Sub-Voucher for accompanied travel conduced from to from 16 April 2021 to 18 April 2021. Petitioner received from Inc. a weighmaster certificate. e. On 19 April 2021, Petitioner received from Certified Automated Truck Scale a weight certificate. f. On 6 May 2021, Petitioner was issued official retirement orders (BUPERS order: ) detaching in May 2021, from , . g. On 11 May 2021, Petitioner’s application for Do It Yourself Move and Counseling Checklist was issued and certified by counselor with an estimated gross incentive of $7,485.53 from to . Petitioner signed the form on 11 May 2021. h. On 21 May 2021, Petitioner received a service receipt from U-Pack for Shipment of Household Goods 17’ Trailer Space from to on 18 May 2021. Petitioner paid $4,732.00. i. On 28 May 2021, Petitioner was issued a certificate of release or discharge from active duty. Petitioner was honorably separated for Disability, Permanent. j. On 21 June 2021, Director, Household Goods Audit Division notified Petitioner that paragraph 051302 A of the Joint Travel Regulation states that transportation of HHGs at government expenses prior to the issuance of permanent change of station orders is not authorized. Exception is made when the order issuing authority (Navy Military Personnel Command) or member designated representative provides a written statement that orders are forthcoming and shipment may be prior to the official issuance of orders. CONCLUSION Upon review and consideration of all the evidence of record, and especially in light of the contents of reference (b), the Board finds the existence of an injustice warranting the following corrective action. The Board concluded that although Petitioner initiated his PPM move prior to the issuance of his orders, in accordance with COMANVPERSCOM message of 10 March 2010 Petitioner had, in writing, notice that retirement orders would be forthcoming, and a retirement date effective 29 May 2021. RECOMMENDATION That Petitioner’s naval record be corrected, where appropriate, to show that: Petitioner was issued official retirement orders (BUPERS order: ) on 13 April 2021 vice 6 May 2021. Furthermore, Petitioner was authorized to submit Personally Procured Move (PPM). Note: Petitioner is advised to resubmit his orders, travel claim, all receipts, and a copy of this Board of Correction of Naval Records (BCNR) decision letter to the Household Goods Audit Team (HHG-AT) for re-adjudication. Settlement of this travel claim is chargeable to the line of accounting on the Petitioner’s official change duty orders (BUPERS order: ). 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
