Pursuant to the provisions of reference (a), Subject, hereinafter referred to as Petitioner, filed enclosure (1) with the Board for Correction of Naval Records (Board), requesting his record be corrected to reflect two additional active duty training periods of service at . 2. The Board consisting of Ms. Mr. and Mr. reviewed Petitioner’s allegations of error and injustice on 10 September 2021 and, pursuant to its regulations, determined the corrective action indicated below should be taken. Documentary material considered by the Board consisted of Petitioner’s application together with all material submitted in support thereof, relevant portions of Petitioner’s naval record, and applicable statutes, regulations, and policies, to include the 25 July 2018 guidance from the Under Secretary of Defense for Personnel and Readiness regarding equity, injustice or clemency determinations (Wilkie Memo). 3. The Board, having reviewed all the facts of record pertaining to Petitioner's allegations of error and injustice finds as follows: a. Before applying to this Board, Petitioner exhausted all administrative remedies available under existing law and regulations within the Department of the Navy. b. Although enclosure (1) was not filed in a timely manner, it is in the interest of justice to review the application on its merits. c. Petitioner enlisted in the United States Marine Corps Reserve (USMCR) on 6 January 1971. On 24 June 1971, Petitioner began initial active duty for training that ended on 14 December 1971. During this period of active service Petitioner was stationed on , from 23 September to 21 October 1971. d. Petitioner was subsequently assigned to Tank Battalion while a member of the USMCR. During his enlistment in the USMCR, Petitioner served on the following periods of active duty for training (ATD): 22 July to 6 August 1972, 9 to 23 August 1973, 6 to 20 July 1974, and 26 July to 9 August 1975. e. On 16 October 2019, Headquarters Marine Corps verified Petitioner’s service on , from 23 September to 21 October 1971. f. Petitioner contends that two of his ATD periods, specifically 22 July to 6 August 1972, and 9 to 23 August 1973, were served on , . Due to these ATD periods not indicating service at , the Department of Veteran Affairs has denied him treatment and compensation. To support his claim, Petitioner submitted statements from fellow Marines who served with him at and a Statement of Service (NA Form 13041) that correlated the above dates to service at . CONCLUSION: Upon review and consideration of all the evidence of record, to include Petitioner’s submitted documents, the Board concluded that Petitioner’s request warrants relief. The Board noted the support statements and NA Form 13041 lend credence to Petitioner’s contention that the two ATD periods in question were served aboard , . RECOMMENDATION: In view of the above, the Board directs the following corrective action: Petitioner be issued official correspondence from Headquarters, Marine Corps indicating that Petitioner served on , from 23 September to 21 October 1971, 22 July to 6 August 1972, and 9 to 23 August 1973. That a copy of this report of proceedings be filed in Petitioner’s naval record. 4. It is certified that a quorum was present at the Board’s review and deliberations, and that the foregoing is a true and complete record of the Board’s proceedings in the above-entitled matter. 5.
